Minutes:

Erection of 2 three-bedroom dwellings and associated parking.

 

      This application was withdrawn from the agenda and would be reported to a future meeting.

20/1356/FH - Hillboro, Sunnyside Road, Sandgate, Folkestone, CT20 3DR

Proposed 4no new dwellings and associated external areas within the curtilage of Hillboro (proposed to be demolished) and accessed from Sunnyside Road via a new private shared drive.

       Mr Nigel Cooke, a local resident spoke against the application.

      Mr Guy Valentine-Neal attended the meeting on behalf of the Sandgate Parish Council and spoke against the application.

       Ms Emily Hadden, the agent for the applicant attended the meeting and spoke in favour of the application.

      Proposed by Councillor Gary Fuller                                                                                     Seconded by Councillor Nicola Keene and

      That the application be refused on the grounds that it was contrary to Policy NE3, and would have an adverse impact on residents and the surrounding landscape.

      Proposed by Councillor Mrs Jenny Hollingsbee                                                                      Seconded by Councillor Philip Martin  

      That the application be approved in accordance with the recommendations of the Chief Planning Offer.                                                                                                          

      Councillors then discussed the application in detail and asked a number of questions, to which the presenting Planning Officer and Chief Planning Officer responded accordingly.                                                         

      The Chairman then put the proposal by Councillor Gary Fuller to the vote, which was as follows:  

       For 6; Against 5; Abstentions 0.

       The proposal to refuse the application was therefore carried.

       The Chief Planning Officer then requested, and it was agreed, that he be granted delegated authority to draft the grounds of refusal.

       RESOLVED:

       That the application be refused, due to the impact of the development not preserving or enhancing the character and appearance of the Sandgate Escarpment  as required by policy NE3.

       And that the Chief Planning Officer be granted delegated authority to agree and finalise the wording of the reason for refusal.

RESOLVED: That planning permission be granted subject to the conditions recommended by the Chief Planning Officer in his report and that he be granted delegated authority to agree and finalise the wording of the conditions and add any other conditions that he considers necessary.

(Voting: For 11; Against 0; Abstentions 0)

 

13.

Without Planning permission or Listed Building Consent the Installation of a New Shop front in the Listed Building 31 - 33 High Street, Hythe, Kent CT21 5AD

Minutes:

This report considers the appropriate action to be taken regarding the unauthorised installation of a new aluminium framed shop front on this Grade II listed building.

 

    Proposed by Councillor Jim Martin      

Seconded by Councillor Jackie Meade and 

 

RESOLVED:

(i) That an Enforcement Notice be served under Section 38 of the Listed Buildings Act requiring the removal of the shopfront and the installation of a wooden framed shopfront of the same design and appearance as the one that has been removed and plate glass windows.

(ii) That an Enforcement Notice be served under Section 72 of the Town and Country Planning Act requiring the removal of the shopfront and the installation of a wooden framed shopfront of the same design an appearance as the one that has been removed and plate glass windows.

(iii) That the Chief Planning Officer be given delegated authority to determine the exact wording of the Notices.

(iv) That the period of compliance with the Notices be (twelve) 12 months.

(v) That the Assistant Director - Governance, Law & Regulatory Services be authorised to take such steps as are necessary, including legal proceedings, to secure compliance with the Notice.
