Apply for building regulations approval

Certain building works that you do at home or at work will need to comply with minimal standards set down by law

For these works you'll need building regulations approval to show they meet these standards.

Building regulations approval is different from planning permission and you may need both.

When you need approval

Building regulations cover the construction and extension of buildings. You may also need approval for alterations such as:

• electrical work
• installing a bathroom
• replacing windows and doors
• replacing roof coverings
• installing or replacing a heating system
• adding extra radiators to a heating system
• putting in a fixed air-conditioning system

When you don't need approval

You don't need approval if the works are exempt or if you're using someone who is on the Competent Person Register to do the work.

Works that you don't need approval for include:

• most repairs, replacements and maintenance work
• exempt buildings

Types of approval

Full plans

Full Plans application is for domestic and commercial works.

You need to submit two copies of:

• signed full plans application form
• detailed specification of the proposed work
• scaled plan (1:50) sections and elevations of the proposal
• site location plan (1:1250) and block plan (1:500)
• vertical section through building showing construction details
• details of provision for drainage
• payment for submission

Payment

Payment is in two parts:

• submission charge - when you submit your application
• inspection charge - when we inspect your works
 
You can pay by cheque (payable to Shepway District Council with the address of the works on the reverse) or you can pay online.

After you've submitted your application

We will assess your plans to make sure they comply with building regulations and raise any queries with you or your architect.

We will let you know our decision within 5 weeks (extendable to 2 months on request).

 

Building Notice

A Building Notice application is for minor domestic works. You don't need to get formal approval as with full plans, but you and your builder need to be competent in dealing with works that meet building regulations.

You can start work two days after you submit your notice.

You need to submit:

• an application form
• a site location plan (1:1250) unless the work is only internal
• drawings if available (not obligatory)
• payment - check our fees

Regularisation

Regularisation is retrospective approval for work that has already been done without consent. This is often picked up during the sale of a property when solicitors ask for a completion certificate.

Your works may need to be uncovered for inspection if you apply for approval retrospectively.

Many people find it hard to sell a house where works were done without approval. The most common projects done without approval are:

• loft conversion
• structural alterations eg removal of a chimney breast

You need to submit:

• an application form
• a plan of the works that were done and how the layout was before
• any additional plans or details showing how you'll bring the works up to regulation standard
• payment (150% of full plans or building notice charge) - check our fees
