Main ContentDischarge of and Compliance with ConditionsUnder the Town and Country Planning (Applications and Deemed Applications) Fees (Amendment) (England) Regulations 2008 fees are now required for the discharge of and compliance with conditions on planning permissions. This will be implemented from 1st June 2008. The fee payable to the Council is £85 per request other than where the related permission was for extending or altering a dwellinghouse or other development in the curtilage of and ancillary to a dwellinghouse, where the fee charged is £25. Any number of conditions can be included in a single written request provided that the necessary information needed to discharge each of the conditions referred to has been provided. Any subsequent written request will attract a new fee. An application seeking approval of details pursuant to a condition must be made in writing and you are requested to use the relevant new nationwide downloadable 1App form - Approval of Details Reserved by Condition that has been specifically designed for this purpose. You may also apply online via the Planning Portal. If insufficient information is provided or if the correct fee has not been paid, then the submission will be made invalid just as it would be if it were a normal planning application and it will not be progressed until the missing information and the correct fee have been provided. If it is invalid you will be sent a letter advising what is required to make the submission valid. For valid submissions an acknowledgement letter will be sent initially and a formal letter will subsequently advise of the Council's decision to approve or refuse the submitted details. The Council will not be able to agree details verbally. Decisions should be made within 8 weeks of receipt of a valid submission. If a decision is not made within 12 weeks the Council is obligated under the new regulations to refund the fee. Requests for written confirmation that a condition has been complied with on site will require a separate fee for this service, which will again be £85 per request or £25 if relating to a householder development.
