Shepway District Local Plan Review - Saved Policies

As part of the transitional arrangement (set out in the Planning and Compulsory Purchase Act 2004) for the move over to the new Local Development Framework (LDF), policies in Local Plans are automatically saved for 3 years from the date the Local Plan is adopted. The Shepway District Local Plan Review was adopted by the council on 16 March 2006 and therefore would run until. 16 March 2009. After this 3 year time period the council must request a direction from the Secretary of State (GOSE) to have specified policies saved. The saved policies continue to be part of the Development Plan and will remain saved until they are replaced by specific LDF policies.

Shepway District Council made a request to GOSE on the 8 September 2008 and confirmation of the policies that are to be saved and retained and those that will expire was received on 27 February 2009. Details on these policies can be viewed below:

The Secretary of State's Direction will come into effect on 16 March 2009 and accordingly all Local Plan policies not saved will no longer have Development Plan status.

Saved Local Plan policies will be used as the basis for all decision making and must be read alongside the Regional Plan and adopted Development Plan Documents as they emerge. In time, emerging Local Development Framework DPD's will replace most Local Plan policies.

The Shepway District Local Plan Review provides detailed policies and specific proposals, which guide the development and use of land in the Shepway area. It was prepared by Shepway District Council, in accordance with Government advice- (set out in Planning Policy Guidance Notes - PPG's), strategic policy (set out in the Kent Structure Plan - Third Review) and regional policy (RPG)

The Local Plan consists of two elements - the Written Statement which sets out policies and proposals with explanatory text and the Proposals Maps which shows the locations of where specific policies and proposals apply.
