New Estate Roads

Before works start on the road house builders can enter into a standard type of agreement known as a Section 38 agreement. The house builder then has the assurance that the road will be adopted providing the road is built in accordance with the Kent Design Guide.

Kent County Council will also have confidence that the quality of the new road will mean a safe, low maintenance road.

Most of the main house builders are used to entering into these agreements throughout England and Wales and this has been a successful way for roads to be adopted for all concerned.

The Section 38 agreement provides:

1.The name of the land owner/house builder who wants the road adopted
2.That Kent County Council will adopt when completed.
3.The maintenance period after which the road can be adopted
4.The name of the company providing the financial bond guaranteeing that the works will be completed, if the house builder stops work. Kent County Council will then be able to pay for the roads to be completed.
5.The amount the house builders will pay to Kent County Council to inspect the works.
