8. Remedies for Anti-Social Behaviour
These can include
- Mediation, this is often the best solution for neighbour disputes and noise problems
- Referring the alleged perpetrator for support
- Warning the alleged perpetrator about their behaviour
- In some case we may wish to set up an agreement with the perpetrator listing what they must stop doing to end the anti-social behaviour and monitor any such agreement. These are called Acceptable Behaviour Contracts or ABC's
- Remove offensive graffiti
- Improve security on council tenants homes
- If legal proceedings are commenced against somebody on the Shepway Housing List their application will be suspended for not less than 12 months and to be reinstated they must prove that they no longer behave in an offensive manner
- Make a referral to the Joint Family Management Programme
8.1 Legal Remedies for Anti-Social Behaviour
If the anti-social behaviour is very serious or if the above remedies have been tried and failed, and there is clear evidence of anti-social behaviour, legal action can be taken. The action the Council can take will depend on a number of factors such as the tenancy status of the perpetrator.
Actions could include:
- Proceedings for evicting council tenants from their home as a result of their behaviour or the behaviour of their children, or visitors
- Proceedings for demoting their tenancy so that it can be ended easily if further incidents occur
- Applications for injunctions
- Applications for anti-social behaviour orders (ASBO's)
- Coast and Countryside Housing Services may also liase with the Police for the investigation of possible criminal offences
- We may also discuss the case with other professional bodies at meetings organised through the Shepway Crime and Disorder Reduction Partnership
- Those responsible for noise where Environmental Health officers have collected evidence could also be prosecuted by the council in the criminal court and have their amplified music equipment seized where appropriate
