Odour

The pollution team at Shepway District Council is responsible for the investigation of odour complaints across the district. The officers within the team work to control unreasonable odour from premises.

The Council has a statutory duty to investigate odour nuisance complaints in accordance with the Environmental Protection Act 1990. Before considering action the pollution team will fully investigate a complaint to determine if the odour amounts to a statutory nuisance. The Council will need to determine the following points:

• the odour occurs often enough
• the extent of the odour and its affect on the complainant
• the odour lasts for unreasonable periods of time.
